SRP® SimRacing Pro Terms and Conditions of Purchase

Welcome to the General Terms and Conditions (GTC) for SRP® SimRacing Pro. This document is crucial as it governs the terms of your purchases on our website, www.simracing-pro.com. By placing any order with us, you fully accept these GTC, which become binding from the moment of your purchase.

It’s essential that you read and agree to these GTC before finalizing any purchase on www.simracing-pro.com.

SRP® SimRacing Pro (SIM RACING PRO 2018 S.L.) is a Spanish company with NIF B55329254, located at Carretera de Tordera 89 Bajos, 17300 BLANES (Girona) – Spain.

We reserve the right to modify these GTC at any time without prior notice. The most up-to-date version will always be accessible on our website for your review or printing.


Pricing and Sales Conditions

The prices and sales conditions displayed on our website are for informational purposes only and may change due to market fluctuations. However, once you complete your order through the purchase form, you commit to the price offered and the general sales conditions in effect at that precise moment.

Once an order is formalized, the purchase is considered final and contractual. Prices and conditions cannot be changed without the express agreement of both parties.

SRP® reserves the right to deny or suspend access to our services on www.simracing-pro.com in cases of breach of contract, violation of applicable legislation, these General Terms and Conditions of Purchase, or if we detect any type of fraud, whether by our company or any of our suppliers.


Shipping

We strive to ensure your order arrives quickly and securely.

  • Domestic Delivery Times (Spain): Generally between 24 and 72 hours, depending on product availability. We do our best to ensure transport companies meet these deadlines. Please note that in remote rural areas, 24-hour delivery cannot always be guaranteed.
  • International Delivery Times: Vary between 2 and 8 business days. While we cannot guarantee these times due to external factors (such as customs or carrier logistics), we strive for orders to arrive as quickly as possible.

Order Receipt and Damage Claims

It’s crucial that you inspect your order upon delivery:

  • You have 72 hours from signing the delivery receipt to verify the integrity of all order components and confirm that everything you ordered is included.
  • After these 72 hours, the shipment will be considered accepted, and no claims for shipping damage or defects will be accepted.

If you receive a product damaged by transport: We strongly recommend you contact us within the first 24 hours of receipt. To process the incident with the transport company, please send clear photographs of the damage (of the product, inner, and outer packaging) to support@simracing-pro.com. It’s also advisable to notify your local transport company of the incident.


Right of Withdrawal (Returns)

At SRP® SimRacing Pro, we respect your right to withdraw from your purchase.

In accordance with the Consolidated Text of the General Law for the Defense of Consumers and Users (TRLGDCU), you can exercise your right of withdrawal. To facilitate and speed up this process, we advise you to send us an email to support@simracing-pro.com informing us of your desire to withdraw.

Important: You will only be liable for any diminished value of the goods resulting from the handling other than what is necessary to establish the nature, characteristics, and functioning of the goods.

The right of withdrawal will not apply to contracts relating to: (You should insert here the specific cases where the right of withdrawal does not apply, such as personalized products, unsealed software if it has been unsealed, etc. The original list was blank.)

Refund Process

Once we receive the returned product(s) and verify their condition, we will process the refund according to your original payment method:

  • Card Payments: The refund will be credited to your bank account within 48 to 72 hours.
  • PayPal Payments: The payment will be credited directly to your PayPal account.

Return Conditions

For a return to be accepted, it is essential to meet the following conditions:

  • Product Condition: All merchandise must be returned in its original packaging and condition, in perfect state, and properly protected. Please avoid applying stickers, seals, or adhesive tapes directly onto the item’s surface or original packaging. If these conditions are not met, SRP® reserves the right to refuse the return.
  • Shipping Period: Once you have emailed us indicating your desire to return the merchandise, we will send you detailed instructions on how to ship it to our facilities. You must send the goods without undue delay, within a maximum of 14 calendar days from the date you communicated your decision to withdraw.
  • Shipping Costs: The transport costs incurred from returning the merchandise will be borne by you. You are free to choose the transport agency that best suits your needs or offers the most competitive rates.
  • Condition After Inspection: Once the merchandise is received at our facilities and verified to be in perfect condition, the full refund will be processed. Should any component of the item be in poor condition (scratches, dents, etc.), the value of that component will be automatically deducted from the refund amount. Original shipping costs (if any) will not be refunded in these cases.
  • Products with Gifts or Promotions: If your purchase included a gift or was part of a promotion, the complete return is mandatory (the full pack or main item + the gift) to proceed with the refund.

Return Conditions for Distributors

Return conditions for distributors differ from those for end consumers:

  • Only returns of unsealed material in perfect condition will be accepted within a maximum of 30 calendar days from receipt.
  • Such returns will be managed as a commercial return, as no specific law regulates business-to-business return rights, and these procedures are governed exclusively by SRP®’s terms and conditions.
  • These conditions do not void your right to warranty or exchange defective products. SRP® reserves the right to refuse a return if a defect is detected in the returned product that is not covered by warranty.

Warranties

All our products come with the applicable legal warranty. The warranty covers manufacturing defects and does not cover problems caused by improper use of the product or handling other than what is necessary to establish its nature, characteristics, or functioning. In such cases, the consumer will be responsible for its repair.

The following cases are therefore excluded from the warranty:

  • Defects and damages caused by external events, accidents (especially electrical), normal wear and tear, or use not in accordance with SRP®’s instructions and recommendations.
  • Products that have been modified or repaired by the customer or any other person not authorized by SRP®.
  • Products that are subject to a specific support contract that governs their own conditions.
  • Incorrect software/hardware configuration by the customer, of a computer, component, or peripheral.
  • Equipment failure caused by a component not supplied by SRP® and incorporated by the customer.

Order Cancellation

Order cancellations that involve a refund to the customer via bank transfer will have a maximum period of 30 days for administrative processing. However, our goal is to not exceed 7 days to expedite the process.


Dispute Resolution

For online dispute resolution in consumer matters, in accordance with Article 14.1 of Regulation (EU) 524/2013, the European Commission provides an online dispute resolution platform. You can access it via the following link: http://ec.europa.eu/consumers/odr/
