SRP® may modify these conditions for future transactions. Subsequent modifications will not affect orders already formalized, unless required by law or expressly accepted by the customer. The most up-to-date version will always be accessible on our website.
1. Orders, Prices & Payment
1.1. Product Information
SRP® strives to ensure that descriptions, photographs, technical specifications, compatibility information and all other content published in the online store is accurate and up to date. Images are illustrative only. Minor differences in tone, finish or appearance may arise from manufacturing, anodizing, machining, lighting or screen-display processes, provided they do not alter the essential characteristics or functionality of the product.
1.2. Prices
The applicable price is the one displayed during the checkout process at the moment the order is placed. Before confirming the purchase, you can review the price of the products, shipping costs and any other amounts calculated by SRP® at that time. Once the order is formalized, SRP® will not unilaterally modify the price.
In the event of an obvious error in the price, description or configuration of a product, SRP® will inform you without delay and, where legally applicable, will offer the option to confirm the order with the correct information or cancel it with a full refund.
1.3. Taxes, Customs & International Sales
Applicable taxes are calculated according to the order destination and the corresponding regulations. For shipments to countries or territories where import duties, tariffs, local taxes, customs fees or management charges may arise, these may be required from the recipient when they have not been expressly included and collected by SRP® during the purchase.
SRP® does not control the amounts charged directly by the customs authorities of the destination country. You are responsible for providing correct and sufficient information for customs processing.
1.4. Order Confirmation
Once your order is successfully placed, SRP® will send a confirmation to the email address provided. You should check the details and report any error as soon as possible. SRP® may request reasonably necessary additional information to verify payment, prevent fraud, correct incomplete data or comply with legal obligations.
2. Availability, Preparation & Delivery
2.1. Availability
Orders are subject to availability. In the exceptional event of a stock shortage preventing supply, SRP® will inform you and offer, as applicable, a new estimated date, an alternative product accepted by you, or cancellation and refund of the amounts paid.
2.2. Pre-Order & Reserved Products
When a product is expressly marketed as pre-order, reservation or awaiting restock, the indicated date is an estimated availability or shipping forecast. SRP® will inform you of any significant delay. Your statutory consumer rights are not affected by the pre-order condition.
2.3. Delivery Times
Displayed delivery times are estimates based on the usual conditions of the selected service. As a reference:
- Spain: generally between 24 and 72 hours from dispatch, depending on product availability. In remote rural areas, 24-hour delivery cannot always be guaranteed.
- International: generally between 2 and 8 business days from dispatch.
These times may be affected by weekends, public holidays, remote areas, customs controls, carrier incidents or circumstances beyond SRP®'s reasonable control. Where Spanish consumer legislation applies and no other period has been agreed, the maximum legal delivery period will be respected.
2.4. Delivery Address
You are responsible for ensuring that the name, address, postal code, country, telephone and email are correct. If the order has not yet been dispatched, SRP® will try to accommodate modifications. Once handed to the carrier, any change is subject to feasibility. Additional costs arising from incorrect or incomplete data, repeated absence or unjustified refusal may be passed on where legally applicable.
3. Order Receipt & Transport Damage
You should check the external condition of the shipment upon receipt whenever reasonably possible. If it shows knocks, punctures, deformations, moisture, openings, tampering or any other visible damage, we recommend noting it with the carrier and keeping evidence.
Reporting outside this recommended period will not by itself entail the loss of your statutory consumer rights where the damage or lack of conformity is covered by applicable legislation.
4. Right of Withdrawal (Returns)
4.1. Period
Consumers entitled to the statutory right of withdrawal may withdraw within the period established by the applicable legislation. In Spain and the European Union, you generally have 14 calendar days from receipt of the product to communicate your decision, without needing to state a reason.
4.2. Communicating Your Withdrawal
You must communicate your decision through an unequivocal statement before the period expires, by email to support@simracing-pro.com. We recommend including your order number and the affected products. SRP® will provide the return instructions and address.
4.3. Return Deadline
Once the withdrawal has been validly communicated, you must return the products without undue delay and, in any case, within 14 calendar days of the date you informed us of your decision.
4.4. Return Costs
Unless SRP® expressly states otherwise or applicable legislation provides otherwise, the direct costs of the return are borne by you. Cash-on-delivery shipments will not be accepted. You must use adequate transport and pack the goods properly.
4.5. Handling & Diminished Value
You may handle the product only to the extent necessary to establish its nature, characteristics and functioning. You will be liable for any diminished value resulting from handling beyond that. For the purpose of assessing a possible diminution, circumstances that may be considered include, among others:
- Scratches, knocks, dents or cosmetic damage.
- Marks caused by screws, nuts, washers, tools or fastening elements.
- Marks or damage derived from installation or removal on a cockpit, structure or mount.
- Wear resulting from use beyond what is necessary to check the product.
- Damage to machined, anodized or painted surfaces.
- Modified, drilled, cut, bent or altered parts.
- Deteriorated screws or components; dirt or residues derived from use.
- Missing or damaged accessories, cables, screws, parts or other originally supplied elements.
A diminished value does not automatically imply the loss of the right of withdrawal. SRP® may deduct from the refund the amount corresponding to the objective loss of value, within legal limits.
4.6. Packaging
The product must be returned properly protected and include all accessories, cables, screws, documentation and supplied components. Whenever preserved, we recommend using the original packaging. Do not place labels, tape or seals directly on the original packaging; use outer protection instead. The absence or deterioration of the original packaging does not automatically entail the loss of the statutory right of withdrawal, although it may be considered where it causes an objective and provable diminution of value.
4.7. Refunds
Where applicable, SRP® will refund the legally corresponding amounts using the same payment method, unless you expressly agree to another method. Where due, the refund will include the costs of the least expensive standard delivery option offered by SRP®; there is no obligation to refund the additional cost of a more expensive delivery method you chose.
- Card payments: credited to your bank account within 48 to 72 hours once processed.
- PayPal payments: credited directly to your PayPal account.
SRP® may withhold the refund until the products are received, or until you provide sufficient proof of their return, whichever occurs first. The time until the amount appears in your account may depend on your bank or payment provider.
4.8. Gifts, Packs & Promotions
Products or accessories delivered free of charge as part of a promotion must be returned when the withdrawal affects the purchase that entitled you to receive them. If they are not returned or show a diminished value attributable to you, SRP® may deduct the corresponding amount from the refund as legally permitted.
5. Exceptions to the Right of Withdrawal
The right of withdrawal will not apply where an exception established by the applicable legislation applies. In particular, it may be excluded for products made to the consumer's specifications or clearly personalized (such as personalized products, custom-built rigs), and for unsealed software and sealed goods not suitable for return for health or hygiene reasons once unsealed.
Choosing a standard option habitually offered by SRP® does not by itself make a product legally "customized".
For digital content not supplied on a tangible medium, the right of withdrawal is lost only when the legal requirements are met, including, where applicable, your prior express consent to begin supply and your acknowledgment of the loss of the right.
6. Order Cancellation Before Shipping
You may request cancellation of an order that has not yet been dispatched by contacting support@simracing-pro.com. Where cancellation is possible and a refund applies, SRP® will return the amounts paid using the same payment method, unless otherwise agreed. If the order has already been dispatched, cancellation and return will be governed by the withdrawal regime or your other statutory rights.
7. Warranty & Non-Conformity
7.1. Legal Warranty
All products marketed by SRP® are subject to the legal warranty and the corresponding conformity regime. For products sold to consumers in Spain, SRP® is liable for any lack of conformity that becomes apparent within the legal period of three years from delivery, in accordance with Spanish legislation. For customers in other countries, the express SRP® warranty applies as a minimum (2 years), together with any warranty or conformity rights that are mandatory under the applicable legislation. No commercial warranty limits your legal rights.
7.2. Remedies for Non-Conformity
Where a legally covered lack of conformity exists, you are entitled to the corrective remedies provided by the applicable legislation. Where Spanish law applies, repair or replacement will be carried out free of charge where legally applicable, within a reasonable period and avoiding significant inconvenience. Price reduction or contract termination will apply in the legally established cases.
7.3. Diagnosis & Technical Support
SRP® may request reasonably necessary information to identify the problem, including photographs, videos, software configuration, firmware version, functional tests or simple technical checks. When replacement of a part or component is required, SRP® may provide it directly where this solution is appropriate and accepted by you, without prejudice to your statutory rights.
7.4. Cases Not Covered
The warranty does not cover damage or breakdowns not originating in a lack of conformity attributable to the product. Excluded, where there is a causal relationship, are damages derived from: use contrary to the instructions or intended purpose; incorrect installation; knocks, drops or accidents; liquids or moisture; power surges or incorrect electrical connections; unauthorized modifications or repairs; incompatible components or third-party accessories causing the damage; transport organized directly by the customer; or normal wear that does not constitute a lack of conformity. The existence of any of these circumstances will be assessed according to the specific cause of the failure and will not automatically exclude unrelated warranty rights.
7.5. Proof of Purchase
SRP® may request an order number, invoice or other proof of purchase to verify the purchase and determine the warranty start date.
8. Return of Replaced Warranty Components
When SRP® sends a free replacement part or component as part of a warranty service, SRP® may request the return of the replaced part when reasonably necessary for technical inspection, quality control or failure analysis. Where SRP® is legally responsible for the costs of bringing the product into conformity, the return of the replaced part will not entail any cost to you. SRP® will provide the necessary instructions.
9. Software, Firmware & Compatibility
Certain SRP® products may require compatible software, firmware, drivers, configuration or hardware. You must respect the technical requirements and instructions indicated by SRP®. SRP® may publish updates to correct errors, improve compatibility, maintain security or add functionality.
Problems caused exclusively by incompatible external software, hardware, configurations or devices will not constitute a lack of conformity of the SRP® product when it meets the communicated compatibility requirements, without prejudice to legal obligations regarding goods with digital elements.
10. Liability
SRP® is liable to the consumer under the applicable legislation. SRP® will not be liable for damages derived from use contrary to the instructions, unauthorized modifications, incorrect installations carried out by the user, or external equipment, where such facts are the cause of the damage. No provision of these conditions excludes or limits liabilities that legally cannot be excluded or limited against consumers.
11. Customer Support & Complaints
For any query, incident, return, warranty matter or complaint related to a purchase, contact support@simracing-pro.com, providing sufficient information to identify the order and describe the issue.
SRP® will endeavor to resolve complaints directly with you, diligently. Where SRP® is legally required to participate in a specific alternative dispute resolution procedure, or is voluntarily adhered to an accredited entity, the corresponding information will be provided in accordance with the legislation.
For consumer dispute resolution matters, you may also contact the European Consumer Centre network through the European Commission's consumer redress portal: https://consumer-redress.ec.europa.eu/
12. Applicable Law & Jurisdiction
These General Terms and Conditions of Purchase are governed by Spanish law, without prejudice to the mandatory consumer-protection rules that may apply to you by reason of your place of residence or other legally relevant circumstances. In case of dispute, the competent courts will be those determined by the applicable legislation. Where you have consumer status, no provision may be interpreted as a waiver of any jurisdiction or protection right that corresponds to you.
13. International Sales & Mandatory Rights
SRP® markets and ships its products internationally. Certain countries or territories may recognize different or additional consumer rights regarding withdrawal, returns, warranty, delivery or termination. When a mandatory rule applicable to a purchase recognizes rights that cannot be validly excluded or limited by contract, those rights will prevail over any incompatible provision of these General Terms and Conditions.
14. Partial Nullity
If any provision is declared null, void or unenforceable, the validity of the remaining provisions will not be affected. The affected provision will be interpreted or replaced, to the extent legally possible, in a manner compatible with the applicable regulations and the contractual purpose.
15. Amendment of These Conditions
SRP® may modify these General Terms and Conditions of Purchase to adapt them to legislative, technical, commercial changes or changes in the store's operation. The new conditions will apply to purchases made after they take effect. The conditions applicable to an order will be those accepted by you when formalizing the purchase, except for subsequent modifications required by a mandatory legal rule.
